ASSISTANT SUPERINTENDENT'S CONTRACT

 

THIS AGREEMENT made this _____ day of February, 2005, between THE BOARD OF EDUCATION OF THE SAUGERTIES SCHOOL DISTRICT, Saugerties, New York, (hereinafter referred to as the "Board") and Cheryl Nucifaro, residing at 3015 Morgan Court, Schenectady, New York (hereinafter referred to as the "Assistant Superintendent")

 

WITNESSETH:

 

FIRST.–The Board and Assistant Superintendent acknowledge that this Agreement, which provides for the terms and conditions of employment of the Assistant Superintendent, is of a non-durational nature and shall continue during the employment of the Assistant Superintendent and until the time of her retirement, resignation or termination from the School District.

 

SECOND: Duties.–The Assistant Superintendent shall perform the duties of Assistant Superintendent of Schools for the Saugerties School District (hereinafter referred to as the "District"), as elsewhere described.

THIRD: Extent of Services.–The Assistant Superintendent shall devote her full time, skill, labor and attention to the discharge of her duties as Assistant Superintendent during the term of this Agreement and shall not engage in any other activities that would interfere with the performance of her duties. However, the Assistant Superintendent, subject to the prior written approval of the Board, may undertake speaking engagements, writing or lecturing work opportunities, with or without remuneration, as long as such activities do not interfere with the full and faithful discharge of the Assistant Superintendent's duties and responsibilities as specified herein. The Board shall not unreasonably withhold its approval for such activities.

FOURTH: Compensation.–The District shall pay to the Assistant Superintendent a gross annual salary for her services in such capacity as follows:

A. The Assistant Superintendent shall be paid an annual salary of Ninety-nine

. Thousand Nine Hundred and 00/100 Dollars ($99,900.00) for the period from February 25, 2004 through February24, 2005.

. B. The Assistant Superintendent shall be paid an annual salary of One Hundred

Three Thousand Eight Hundred Ninety Six and 00/100 Dollars ($103,896.00) for the period from February 25, 2005 through February 24, 2006.

. C. Upon receiving a satisfactory evaluation done by the Superintendent of Schools, the Assistant Superintendent will receive a salary increase equivalent to that of the administrative union on February 25, 2006 and again on February 25, 2007 with the same evaluative condition; provided, however, that the Assistant Superintendent's salary shall not be reduced from the previous year's amount upon such annual review. This in no way prevents the Superintendent and Board of Education from exercising its right to terminate the Assistant Superintendent during her probationary period.

. D. Salary shall be paid in equal installments in accordance with the rules of the Board governing payment of the professional staff members of the District.

FIFTH. Benefits.–In addition to gross annual salary, the Board shall pay, provide or make available to the Assistant Superintendent, the following:

. A. Health Insurance. The District shall provide the Assistant Superintendent with hospital and medical insurance coverage under the District's Health Insurance Plan, with the District contributing 90% toward the cost of the plan and the

.

Assistant Superintendent contributing 10% toward the cost of the plan. If the Assistant Superintendent is otherwise health insured, she may opt out of the District health insurance program and receive a payment equal to 75% of the annual cost of the family plan provided by the District. Such payment shall be made in two installments: one on or before November 1st and the other on or before April 1st. Re-entry into the District health plan shall be allowed at any time subject to the posted health insurance plan rules.

. B. Dental Insurance. The Assistant Superintendent shall receive the same dental

insurance coverage for herself and her family that is provided to members of the Administrative and Supervisory Personnel Association of the Saugerties Central School District.

. C. Cafeteria Plan. The District shall establish a qualified cafeteria plan, as defined in Section 125 of the Internal Revenue Code of 1986, as amended, for the Assistant Superintendent.

 

SIXTH: Vacation and Personal Days.--

. A. Vacation. The Assistant Superintendent shall be entitled to twenty (20) paid vacation days annually. Such vacation shall be scheduled subject to the Superintendent's discretion as to the reasonable operating needs of the District. Vacation may accumulate to twenty (20) days.

. B. Personal Days. The Assistant Superintendent is granted annually five (5) days of leave with pay for emergency or personal reasons which may not be accomplished during the regular work day. The utilization is subject to the approval of the Superintendent. There shall be no accumulation of personal days. Unused personal days will convert to sick days at the end of the year.

 

SEVENTH: Sick Days.--

A. The Assistant Superintendent will be granted one (1) sick day per month with days accumulating to a maximum of 220 days. There will be no pay for unused accumulated sick days.

 

EIGHTH: Professional Meetings and Organization.–The Board is desirous that the Assistant Superintendent grow professionally and, therefore, shall pay reasonable expenses, up to the amount set forth in the budget, for publications for the Assistant Superintendent, the Assistant Superintendent's attendance at professional meetings at the local, state and national levels and participation, including dues, in up to three appropriate professional organizations. The Assistant Superintendent shall provide a report to the Board upon her return from any conferences or conventions that last longer than two (2) days.

 

NINTH: Evaluation.--

A. The Superintendent shall evaluate and assess, in writing, the performance of the Assistant Superintendent at least once per year. The evaluation and assessment shall be reasonably related to the position description of Assistant Superintendent of Schools and the goals and objectives of the District in the year in question. The Assistant Superintendent shall be entitled to receive a copy of the annual evaluation and shall be afforded an opportunity to respond to such evaluation.

 

TENTH: Certification.–The Assistant Superintendent represents that she will throughout the term of her employment hold a valid certificate to act as an Assistant Superintendent of Schools in the State of New York, and that proof of said certification shall be attached to this Contract.

 

ELEVENTH: Applicable Law.–This Agreement and all of its provisions shall be construed and interpreted in accordance with the laws of the State of New York and applicable rules and regulations as they may be amended.

 

TWELFTH: Separability.–Should any provision, term, condition, paragraph, phrase or portion of this Agreement be held or found void or illegal, the balance of the Agreement shall remain in full force and effect.

 

THIRTEENTH: Full Agreement.–This Agreement constitutes and full and complete agreement of the parties and incorporates all prior understandings of the parties. The terms of this Agreement may be changed only by such further written agreement as may amend same provided that any such future agreement is executed with the same formality as this Agreement.
